He was "non-white", and had previously appeared at tribunal to present as a conscientious objector in July 1943, saying he would not fight for a country that did not give equality to non-whites.
His mother said she would rather he went to prison as colour bar was as rife in the army as anywhere. Judge Finnemore disputed this and said he would soon be popular in the army, but accepted there was a great deal further to go before white & black races treated each other properly.
He was denied C.O status.
